Terms & Conditions

1. Acceptance of Terms

By accessing or using the Pharmocia customer platform (web or mobile), you agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, you must discontinue use of the platform immediately. These terms apply to all users of the service, including customers who browse, purchase, or otherwise use the platform.

2. Eligibility

You must be at least 18 years of age to use Pharmocia. By using the platform, you represent and warrant that: • You are at least 18 years old, or are using the platform under the supervision of a parent or legal guardian. • You have the legal capacity to enter into a binding contract. • You are a resident of India and your use complies with applicable Indian laws.

3. Platform Services

Pharmocia provides an online marketplace that connects customers with licensed pharmacy partners. We facilitate the ordering and delivery of medicines, healthcare products, and related services. Pharmocia does not itself dispense medicines — all dispensing is done by licensed pharmacy partners. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

4. Account Registration & Security

You are responsible for maintaining the confidentiality of your account. OTP-based authentication is used for all sign-ins. You agree to: • Provide accurate and complete registration information. • Notify us immediately of any unauthorised use of your account. • Accept responsibility for all activities that occur under your account. We reserve the right to suspend or terminate accounts we reasonably believe are being used fraudulently or in violation of these terms.

5. Prescription Medicines

Certain medicines require a valid prescription from a registered medical practitioner. You agree to: • Upload a valid, legible prescription when ordering Schedule H, Schedule H1, or Schedule X drugs. • Not misrepresent, falsify, or alter any prescription document. • Ensure prescriptions are issued by a licensed practitioner in India. Pharmacies reserve the right to refuse dispensing any medicine if a prescription is missing, invalid, or suspected to be forged. Violations may be reported to the relevant authorities.

6. Pricing, Payments & Wallet

All prices displayed are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without notice. Payments are processed through third-party payment gateways. Pharmocia does not store card details on its servers. Wallet credits are non-transferable, non-refundable as cash, and expire as stated in the relevant promotion. In the event of a payment failure or disputed charge, you agree to contact us through the in-app or on-site support channel.

7. Orders, Cancellations & Returns

Once an order is accepted by a pharmacy partner, cancellation may not always be possible. Requests before dispatch will be accommodated where feasible. Returns are subject to applicable laws. Medicines cannot be returned once dispensed unless the product is damaged, defective, or incorrectly supplied. Healthcare and personal hygiene products are non-returnable unless defective. Refunds for eligible returns will be credited to the original payment method or your Pharmocia wallet within 5–7 business days.

8. Delivery

Delivery timelines are estimates and may vary due to traffic, weather, stock availability, or unforeseen circumstances. Pharmocia is not liable for delays caused by circumstances beyond its reasonable control. You are responsible for ensuring someone is available to receive the delivery at the provided address. Failed delivery attempts may result in order cancellation.

9. Prohibited Conduct

You agree not to: • Use the platform for any unlawful purpose. • Submit false prescriptions or fraudulent orders. • Attempt to circumvent security features. • Engage in any conduct that disrupts the service for other users. • Scrape, copy, or reverse-engineer any part of the platform.

10. Intellectual Property

All content, trademarks, logos, and software on the Pharmocia platform are owned by or licensed to Pharmocia. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Pharmocia and its partners, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability to you for any claim shall not exceed the amount paid by you for the specific order giving rise to such claim.

12. Governing Law & Disputes

These Terms are governed by the laws of the Republic of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of India. We encourage you to use the in-app or on-site support channel to resolve any concern before initiating formal proceedings.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the platform after any update constitutes your acceptance of the revised terms. We will make reasonable efforts to notify you of material changes through the platform.
